These Terms & Conditions (“Terms”) set out the rules governing access to and use of the website at https://pravahax.com and its associated public pages, forms, content and functionality (collectively, the “Website”).

The Website is operated by PRAVAHAx Systems Engineering, an Indian partnership firm based in Chhatrapati Sambhajinagar, Maharashtra 431001, India (“PRAVAHAx”, “we”, “us” or “our”).

These Terms primarily govern:

• access to and use of the Website;
• use of Website content;
• inquiries submitted through the Website;
• career and internship applications;
• acceptable use of Website functionality;
• intellectual-property rights relating to the Website;
• user-submitted material;
• third-party links;
• security and responsible Website use; and
• other interactions with the public Website.

Please read these Terms together with our Privacy Policy and any other notice specifically presented in connection with a particular Website function.

Where affirmative contractual acceptance is legally or operationally required for a particular transaction, programme or service, PRAVAHAx may use a separate acceptance mechanism or separate agreement.

These Terms apply to the public Website and Website-based interactions.

They do not, by themselves, govern the detailed terms of an engineering, software, consultancy, research or other professional engagement entered into separately with PRAVAHAx.

A client engagement may instead be governed by documents such as:

• a proposal;
• statement of work;
• service agreement;
• non-disclosure agreement;
• project agreement;
• purchase order accepted by PRAVAHAx; or
• another separately agreed commercial contract.

Where a separately executed agreement between PRAVAHAx and another party applies to a particular commercial engagement and conflicts with these Website Terms, the separately executed agreement will govern that engagement to the extent of the conflict.

Accessing the Website, viewing its content, submitting an inquiry, sending an email or otherwise communicating with PRAVAHAx through the Website does not, by itself:

• create a client relationship;
• create a professional-services engagement;
• create a partnership, joint venture or agency relationship;
• require PRAVAHAx to accept or undertake a project;
• constitute acceptance of any proposed scope, specification or commercial terms;
• create an employment or internship relationship; or
• create a confidentiality or non-disclosure agreement.

A professional or commercial relationship begins only where PRAVAHAx and the relevant party separately agree to the applicable engagement.

The Website may contain information relating to areas such as systems engineering, software and technology, artificial intelligence, research, consultancy, engineering services, technical concepts, articles, documentation and other educational or informational material.

Unless expressly stated otherwise, this material is provided for general informational purposes.

Website content does not constitute project-specific engineering, technical, legal, financial or other professional advice and should not be treated as a substitute for an assessment based on the circumstances and requirements of a particular project.

Technology, research, software and engineering practices evolve. Although PRAVAHAx may update Website content from time to time, we do not represent that every item of Website content will remain current, complete or suitable for every particular purpose.

The Website may allow users to submit inquiries relating to matters such as general questions, services, consultancy, research, potential projects, careers and internships.

Submitting an inquiry does not require PRAVAHAx to:

• accept a project;
• provide a quotation;
• enter into negotiations;
• provide services;
• respond within a particular period; or
• enter into a contractual relationship.

PRAVAHAx may request additional information where reasonably necessary to understand or evaluate an inquiry.

Communications resulting from an inquiry are for the purpose of addressing that inquiry or a related potential relationship and are not permission for unrelated advertising or promotional communications.

A submission through a public Website form, or an unsolicited email sent to PRAVAHAx, does not by itself create a confidential relationship or non-disclosure obligation.

You should therefore avoid sending highly confidential information, trade secrets, security credentials, production access credentials, sensitive source code or other information requiring contractual confidentiality unless:

• PRAVAHAx has specifically requested the information;
• an appropriate confidentiality arrangement is already in place; or
• another secure or agreed process has been established.

Where PRAVAHAx and another party have entered into a separate non-disclosure or confidentiality agreement, that agreement will govern information within its scope.

Nothing in this section permits PRAVAHAx to use personal data contrary to its Privacy Policy or applicable law.

You retain ownership of documents, information and other material that you own and submit to PRAVAHAx.

Submitting material through the Website does not transfer ownership of that material to PRAVAHAx.

However, where you voluntarily submit material in connection with an inquiry, application or other Website interaction, you grant PRAVAHAx a limited, non-exclusive permission to receive, access, reproduce where reasonably necessary, review, evaluate and use that material solely as reasonably necessary to:

• process the relevant submission;
• evaluate the inquiry or application;
• communicate with you;
• determine whether PRAVAHAx wishes to pursue the relevant relationship; and
• maintain records where reasonably or legally required.

This permission does not give PRAVAHAx a general right to commercially exploit your submitted material for unrelated purposes.

You should only submit material that:

• you are entitled to provide;
• does not unlawfully infringe another person’s intellectual-property or other rights; and
• does not contain malware, malicious code or unlawful content.

Where you provide a link to content hosted by a third party, such as GitHub or a portfolio platform, access to that content may also be governed by the terms and permissions applicable to that third-party service.

PRAVAHAx may publish or accept applications for career and internship opportunities through the Website.

Submitting an application:

• does not guarantee that an applicant will be shortlisted;
• does not guarantee an interview;
• does not guarantee employment, internship placement or participation;
• does not create an employment or internship relationship; and
• does not require PRAVAHAx to keep an opportunity open for any particular period.

PRAVAHAx may evaluate applications based on the requirements relevant to the particular opportunity and applicable law.

Availability, scope, schedules, requirements and other details of an opportunity may change before a formal offer or acceptance.

Where an applicant is selected, the resulting employment, internship, training or other formal relationship may be subject to separate terms, documents or agreements.

The Website does not currently provide a general online checkout, Website subscription payment or online purchase process.

These Terms therefore do not establish payment, cancellation or refund rules for Website transactions that do not currently exist.

PRAVAHAx may introduce additional services or transactional functionality in the future. Where a new feature requires additional contractual terms, disclosures or affirmative acceptance, appropriate terms will be implemented before or in connection with that feature.

In particular, any future paid internship or training programme involving online payment will require separate review and appropriate programme, payment, cancellation/refund and, where relevant, guardian-related terms before that functionality goes live.

You may use the Website only for lawful purposes and in a manner that does not interfere with its operation, security or legitimate use by others.

You must not knowingly or intentionally:

• attempt to gain unauthorised access to the Website, servers, systems or accounts;
• bypass security, access-control or technical restrictions;
• introduce viruses, malware, malicious scripts or other harmful code;
• conduct denial-of-service attacks or deliberately disrupt Website availability;
• use Website forms to distribute spam or malicious content;
• submit fraudulent or deliberately misleading applications;
• impersonate another person or falsely represent an affiliation;
• use the Website to infringe intellectual-property, privacy or other legal rights;
• use automated systems in a manner prohibited by Section 12 of these Terms;
• use the Website for unlawful activity; or
• attempt to compromise Website infrastructure or other users.

PRAVAHAx may take proportionate technical or administrative measures to protect the Website against misuse, malicious activity, automated abuse or security threats.

Unless otherwise indicated, the Website and material created and published by PRAVAHAx may include intellectual property belonging to or lawfully used by PRAVAHAx Systems Engineering, including:

• the PRAVAHAx name and branding;
• logos and graphical elements;
• Website text;
• designs;
• service descriptions;
• articles and research material;
• technical documentation;
• software-related materials;
• original graphics;
• concepts to the extent protected by applicable intellectual-property law; and
• other original Website content.

You may access and view publicly available Website content for lawful informational, evaluation and reference purposes.

Unless permitted by applicable law, an applicable licence or written permission from PRAVAHAx, you must not systematically or commercially:

• reproduce substantial Website content;
• republish Website content as your own;
• sell or commercially redistribute Website content;
• mirror substantial portions of the Website;
• falsely claim ownership or authorship;
• use PRAVAHAx branding in a manner suggesting an unauthorised endorsement, partnership or affiliation;
• create unauthorised commercial derivative material from protected Website content; or
• remove or misrepresent applicable copyright, trade-mark or ownership notices.

Nothing in these Terms is intended to prohibit uses that cannot lawfully be restricted, including applicable statutory exceptions or rights. Content identified as open-source, third-party or subject to a separate licence remains governed by the applicable licence or rights of its respective owner.

PRAVAHAx permits ordinary public indexing and reasonable automated retrieval intended to make publicly available Website content discoverable, searchable, referenced, summarised or cited to users.

This includes ordinary search-engine indexing and comparable search or AI-assisted reference functionality, provided such activity does not involve prohibited bulk or exploitative use.

Unless separately permitted by PRAVAHAx or applicable law, you must not use automated means to:

• systematically scrape substantial portions of the Website;
• create or maintain a bulk copy or mirror of Website content;
• extract Website content at scale for commercial datasets;
• build a competing content repository or database from PRAVAHAx content;
• circumvent robots, rate limits, access controls or other technical restrictions; or
• use protected PRAVAHAx Website content as training data for developing or improving an artificial-intelligence or machine-learning model.

Ordinary indexing, linking, search retrieval, reference, citation and reasonable summarisation should not be treated as prohibited solely because an automated system is involved.

This section does not override applicable law, statutory exceptions, separate licences or permissions expressly granted by PRAVAHAx.

PRAVAHAx welcomes good-faith notification of suspected Website security vulnerabilities.

Reporting a suspected vulnerability in good faith does not, by itself, violate these Terms.

However, these Terms do not grant authorisation to:

• gain unauthorised access to systems or data;
• retrieve or alter information belonging to other persons;
• install malware;
• disrupt Website services;
• exploit a vulnerability beyond what is reasonably necessary to identify that a potential issue exists;
• perform destructive testing; or
• conduct intrusive security testing without permission.

PRAVAHAx may establish a separate vulnerability-disclosure or authorised security-testing policy in the future.

The Website may contain links to websites, profiles, repositories or services operated by third parties, including social-media and technical platforms.

A link does not necessarily mean that PRAVAHAx:

• controls the third-party service;
• endorses every statement or activity of the third party;
• guarantees the availability or security of the service; or
• accepts responsibility for the third party’s separate terms, policies or practices.

When you leave the PRAVAHAx Website, the relevant third party’s terms and privacy practices may apply.

Personal data submitted through or in connection with the Website is handled in accordance with the PRAVAHAx Systems Engineering Privacy Policy.

The Privacy Policy explains, among other matters:

• the categories of information PRAVAHAx currently receives;
• how inquiries and applications are handled;
• career and internship application processing;
• parent/legal-guardian involvement for under-18 internship applicants;
• current service providers;
• retention practices;
• privacy requests; and
• browser-side functional storage.

Acknowledging or reading the Privacy Policy does not constitute blanket consent to unrelated or undisclosed processing.

Where separate consent or another legal step is required, PRAVAHAx may use a separate mechanism.

PRAVAHAx may periodically:

• update Website content;
• change Website layouts or functionality;
• add, modify or remove Website features;
• update descriptions of services or opportunities;
• perform maintenance;
• temporarily restrict access where reasonably necessary; or
• discontinue Website functionality.

PRAVAHAx does not guarantee that the Website or every feature will be continuously available without interruption or error.

Where reasonably practicable, PRAVAHAx will seek to maintain the Website appropriately, but maintenance, technical faults, service-provider outages, security events and circumstances outside PRAVAHAx’s reasonable control may affect availability.

PRAVAHAx aims to provide useful and reasonably accurate Website information.

However, to the extent permitted by applicable law, we do not guarantee that:

• every item of Website information is complete or error-free;
• all information will remain current at all times;
• Website content will be suitable for every user’s particular circumstances;
• the Website will always operate without interruption; or
• every third-party link will remain available or unchanged.

Users should obtain project-specific information or advice where a decision depends on particular technical, commercial, legal or other circumstances.

Nothing in these Terms excludes any guarantee, right, remedy or obligation that cannot lawfully be excluded.

This section concerns use of the public Website. It does not replace liability provisions contained in a separate client, service, project, employment, internship or other agreement.

To the extent permitted by applicable law, PRAVAHAx will not be responsible for indirect, incidental, special or consequential loss arising solely from use of, inability to use, or reliance on the public Website where such loss is not a liability that applicable law requires PRAVAHAx to bear.

PRAVAHAx is not responsible for loss caused solely by:

• reliance on general Website information as though it were project-specific professional advice;
• the independent acts or omissions of third-party websites or services;
• circumstances outside PRAVAHAx’s reasonable control; or
• unlawful or unauthorised use of the Website by another person,

except to the extent applicable law provides otherwise.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct or any other liability that cannot legally be excluded or limited.

Nothing in these Terms limits mandatory consumer rights or remedies available under applicable law.

Liability relating to an actual commercial engagement with PRAVAHAx will be governed by the applicable agreement for that engagement where one exists.

To the extent permitted by applicable law, you may be responsible for reasonable losses, liabilities, costs or third-party claims suffered by PRAVAHAx to the extent they directly result from your:

• deliberate unlawful misuse of the Website;
• fraudulent activity through the Website;
• knowing submission of material that infringes a third party’s rights;
• knowing introduction of malware or malicious code; or
• other intentional conduct that materially violates these Terms and causes a third-party claim against PRAVAHAx.

This provision is intended to address serious or unlawful misuse.

It is not intended to impose an indemnity merely because a person:

• visits the Website;
• submits an ordinary good-faith inquiry;
• submits a genuine application;
• makes a legitimate complaint; or
• reports a suspected security vulnerability in good faith.

PRAVAHAx may restrict, block or take other proportionate measures against access reasonably believed to involve:

• malicious traffic;
• attacks on Website infrastructure;
• automated abuse;
• fraud;
• repeated spam;
• unlawful conduct; or
• material violations of these Terms.

Because the Website does not currently operate a general user-account system, references to restriction or blocking primarily concern Website access, requests, traffic and form functionality rather than termination of a user account.

Nothing in these Terms is intended to alter a separately executed agreement between PRAVAHAx and a client, partner, applicant, employee, intern, contractor or other party.

Where a valid separate agreement applies to a specific relationship and contains terms inconsistent with these Website Terms, the separate agreement governs that specific relationship to the extent of the inconsistency.

PRAVAHAx may update these Terms when reasonably necessary because of changes to:

• Website functionality;
• services;
• business operations;
• applicable legal requirements;
• Website risks;
• forms or application processes; or
• other material circumstances.

The current version and “Last updated” date will be displayed on this page.

Minor editorial, formatting or clarification changes may be made without requiring Website users to affirmatively acknowledge the Terms again.

Where a material new Website function creates a relationship for which affirmative contractual acceptance is appropriate, PRAVAHAx may implement a separate acceptance mechanism.

PRAVAHAx does not currently require every ordinary Website visitor to complete a Terms-acceptance popup merely to view public Website content.

These Terms are based on the Website functionality currently offered.

PRAVAHAx should review and, where appropriate, update these Terms before introducing materially different functionality such as:

• online payments;
• paid internship or training checkout;
• subscriptions;
• user accounts;
• SaaS products;
• client portals;
• online purchasing;
• downloadable software requiring specific licence terms;
• API access;
• community functionality;
• paid courses or certifications; or
• other functionality creating materially different contractual obligations.

The existence of this section does not mean any such feature is currently available.

These Terms are primarily governed by the laws of India, subject to any mandatory law that applies and cannot validly be excluded or restricted.

If a dispute arises specifically concerning use of the Website or these Terms, the person raising the dispute and PRAVAHAx should first attempt to resolve it in good faith through written communication.

The parties should ordinarily allow up to 30 days for a good-faith attempt at resolution before commencing court proceedings, unless urgent relief is reasonably required or applicable law provides otherwise.

If the dispute cannot be resolved, courts of competent jurisdiction in Chhatrapati Sambhajinagar, Maharashtra, India may have jurisdiction, subject to:

• applicable rules determining lawful court jurisdiction;
• mandatory consumer forums or remedies;
• statutory rights that cannot validly be restricted; and
• any different dispute mechanism contained in a separately applicable agreement.

These Terms do not require arbitration.

If a provision of these Terms is found by a competent authority to be invalid, unlawful or unenforceable, that provision should be interpreted or limited to the minimum extent reasonably necessary, where legally permissible.

The remaining provisions will continue to apply to the extent they can lawfully operate independently.

If PRAVAHAx does not immediately exercise a right or remedy available under these Terms or applicable law, that does not necessarily mean that the right or remedy has been waived.
